I, (Name)_____________________________ agree to mail my rent to P.O.
Box 1023, by the FIRST (1ST) day of each month. I also understand
that should I fail to pay by the THIRD (3rd) of the month, a late
charge fee of TWENTY-FIVE (25%) percent will be added to the rent and the owner
will start the eviction process.
The deposit in the amount of $___________
is to be held in escrow to defray the costs of any cleaning, damages and/or
utility bills incurred by the tenant and unpaid at the time of vacating.
1.
_____I agree to notify the owner or manager a
minimum of FIFTEEN (15) days prior to vacating the property. This time period is
waived should I be required to vacate due to permanent change of station (PCS)
military orders. I understand that my failure to provide the necessary
notification will result in my forfeiture of the security deposit as well as any
remaining monies paid for rent.
2.
_____I agree that under no circumstances will any
person/persons, other than those listed, be allowed to make residence at said
property at any time without the approval of the owner/manager. Guests staying
more than THREE (3) days must be registered at the office. The owner/manager has
the right to assess any additional charges for guests staying for more than SIX
(6) days.
3.
_____I agree that there shall be no washing of
automobiles and I will park no more than TWO (2) vehicles in the driveway and
that NO vehicles are permitted on the grassy areas. Also, no car
repairs/maintenance are allowed nor is storage of car parts permitted on the
premises. Any cars that are leaking oil or transmission fluid will be towed at
the owner/manager’s request.

_____I agree to notify management of any pets that
I wish to keep on the premises. There will be a One Hundred Dollar ($100)
non-refundable deposit PER PET and there will be NO pets weighing
over 15 pounds allowed.
5.
_____I agree to maintain the property in
a high state of cleanliness at all times and will keep the yards clean and free
of paper, leaves, branches and trash. I understand that I will be responsible
for the upkeep of cutting the grass during the summer months and that my failure
to keep the yard clean, cut and raked that there will be a $50 fee payable to
management.
6.
_____I understand that if damages to the property
are a result of my negligence that I will be held responsible for all costs
incurred. If it is determined that sewer/drain stoppages are caused by personal
hygiene, paper towels or other items not suitable for disposal are found to have
blocked the drainage system, I will be held responsible for all charges incurred
for the repair of such system.
7.
_____I am responsible for promptly reporting any
water leaks (drain, faucet, roof, window, etc.) that may cause damage to the
property. If I fail to report leakage problems, I understand that I will be held
responsible for the damages resulting from the leak. I also understand that I am
responsible for damages to the plumbing system caused by my not maintaining the
heating within the property at a high enough level to prevent freezing commodes,
faucets, pipes, etc.
8.
_____The property owner is not responsible for the
loss of or damage to any property belonging to the tenants/visitors as a result
of appliance malfunctions, fire, theft, and or any act of God (Tornado, Thunder
Storms or Ect.) The owner is not responsible for these occurrences and it is my
responsibility to obtain insurance of my own choosing to cover any liability
claims for such.
9.
_____ATTN: Fences and trees are not to be climbed
nor are objects to be thrown at any one on the property. Your children/guests
are your responsibility; please inform them.
10.
_____I understand that should I not abide by the
aforementioned rules, the owner/manager has the right to terminate this
agreement providing me with SEVEN (7) days notice. Further, I understand that
the owner has a master key to the premises for use in case of emergencies or
repairs to the property. (Tenant will incur all charges
to open any lock changed by the tenant, keeping management from entering
property for emergencies or repairs needed.)
11.
_____The terms of this agreement will be effective
on the FIRST or FIFTEENTH (1st or 15th) of the calendar
month that the agreement is signed.
12.
_____I agree to have all utilities terminated to
the home and have the cleaning checklist completed and signed by the
owners/manager at the time of checkout. There is a mandatory FORTY-FIVE DOLLARS
($45) fee for the steam cleaning of the carpets. I also understand that any
items remaining in the property or on the lot beyond this period will be
considered abandoned and will be disposed of. Check out time will be 12:00 Noon.
13.
____ MidTown Properties will offer, all new tenants,
1-Month free rent. The free month rent, is based on the tenant paying their
deposit and first five months of rent “ON TIME” with NO late fees incurred
during the entire150 day cycle. Midtown Properties, will PAY the sixth month
rent, this will be a ONE-time basis only. NOTE: (Any
late fee’s incurred by “ YOU THE TENANT “ during this 150 day cycle VOIDS Item
13 of this contract.)
